About

About Merschbrock Law

Clayton Merschbrock is a lien resolution attorney and founder of Merschbrock Law LLC, a lien resolution law firm serving personal injury attorneys nationwide. Clayton has spent more than a decade in the lien resolution and healthcare recovery space, resolving thousands of lien and subrogation matters across the country. His work has eliminated or reduced hundreds of millions of dollars in asserted recoveries, ensuring injury victims keep more of their settlement and that attorneys avoid costly compliance pitfalls.

He has extensive experience handling every category of healthcare lien, subrogation, and reimbursement claim, including ERISA liens, FEHBA plans, Medicare liens, Medicare Advantage plans, Medicaid liens, VA and TRICARE subrogation, Workers’ Compensation liens, Short-Term Disability plans, Hospital Liens, and outstanding medical provider balances.

Clayton began his lien resolution career on the ground floor as a Subrogation Analyst, eventually becoming a Subrogation & Litigation Attorney for the nation’s largest post-payment healthcare recovery vendor. There, he advised benefit plans, managed complex recovery litigation, and negotiated thousands of reimbursement claims — giving him an insider’s understanding of how insurers and recovery vendors operate.

Since transitioning to the plaintiff’s side in 2019, he has leveraged that insider knowledge to advocate for injury victims nationwide — strategically reducing lien burdens and maximizing net recovery at settlement. Today, Clayton speaks and teaches across the country, delivering CLEs, presentations, and training to help personal injury attorneys navigate the increasingly complex world of subrogation and lien resolution.
