Lien resolution is one of the most underrated skill sets in plaintiff personal injury practice. The work touches every file, drives a real piece of the client’s net recovery, and shows up at the worst possible moment if it is not managed early. The presentation walks through the full workflow that plaintiff paralegals can use to take a file from intake through final lien resolution. Topics include:

  • The categories of liens and subrogation claims that appear in personal injury cases, including ERISA plans, Medicare, Medicare Advantage, Medicaid, FEHBA, Tricare, workers’ compensation, hospital liens, and outstanding provider bills
  • How to identify which type of claim you are actually dealing with, and why the answer changes everything that follows
  • The intake questions that surface lien exposure at the start of the case, instead of two weeks before settlement
  • Verification documents to request from each lien holder, and what to do when they refuse to produce them
  • Common reduction levers and the legal authority behind them
  • Documentation and closing practices that protect the firm and the client

Why this matters for paralegals

Paralegals are the first line of defense on lien issues in most plaintiff firms. They are the ones reading EOBs, coordinating with recovery vendors, building the lien ledger, and flagging issues for the attorney. When the process is repeatable, the file moves. When it is not, the file stalls and the client’s net suffers.

The goal of Liens Without the Headache is to give paralegals a framework they can use Monday morning, and the confidence to push back when a recovery vendor’s number does not look right.
